Apple defeats Samsung in European court

Apple has achieved a decisive victory in the ongoing patent war with Samsung with a Dutch judge banning the sale of three Samsung devices from mid-October onwards…

“Samsung’s smart phones cannot be sold. That goes for the Samsung S, the Samsung S II and the Samsung Ace,” Saskia Panchoe, spokeswoman for the Hague-based court told AFP.

Specifically the infringements surrounded the fashion in which users scroll through an select photos in the Samsung’s photo gallery and the way the devices are activated via the touch screen.

Apple had filed to have the three smart phones and three tablets removed from the market, however the judge ruled that the tablets did not infringe any of Apple’s patents or designs.

The case is part of the continuing patent war between the two companies which has them both pursing action against the other in various courts worldwide. Apple also launched Australian legal proceedings against Samsung in September, accusing it of infringing its patents with the Galaxy Tab 10.1.
